This Short Term Rental Agreement (the “Agreement”) is made by and between Lemson Investments, LLC (“Homeowner”) and _____________________ (“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located in Groveland, CA. Full address and access information will be provided upon receipt of final payment.

The property is furnished and includes dishwasher, refrigerator, stove, oven, blender, juicer, coffee maker, toaster, DVD player (Blu-ray), TV, Wi-Fi, Xbox 360, Wii, Electronic dart board, linens, bath towels, face towels, dish towels, dishes, silverware, serving spoons, pots and pans, and BBQ.

2. Rental Party: The rental party shall consist of Guest and the following persons:

3. Maximum Occupancy: The maximum number of guests is limited to 10 persons.

4. Term of the Lease. The lease begins at 3pm on ____________ (the “Check-in Date”) and ends at 11am on ________________ (the “Checkout Date”).

5. Minimum Stay: This property requires a 2 night minimum stay during off-season (9/6/14 – 4/30/15) and a 7 night minimum stay during peak-season (5/1/15-9/12/15). Holiday periods have their own minimum stays. If a rental is taken for less than the minimum number of days, the guest will be charged for the applicable minimum number of days.

6. Rental Rules: Guest agrees to abide by the Rental Rules at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Violation of these rules can result in premature termination of the lease and guest and rental party’s immediate departure. No refunds are provided for early termination of the lease.

7. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

8. Rental Rate and Fees

a. Deposit: A deposit of $400 is due 48 hours from date of booking. The deposit is initially a reservation deposit to hold the date and is non-refundable. Upon check-in, the reservation deposit converts to a refundable security deposit and shall be refunded within 21 days of the Checkout Date provided no deductions are made due to:

i. damage to the property or furnishings;

ii. dirt or other mess requiring excessive cleaning;

iii. Internet usage that exceeds 10 Gigabytes per week; or

iv. any fines/penalties assessed to Homeowner due to Guest’s stay.

We rarely deduct from a deposit. In the event that we must deduct from your deposit, we will provide an itemized record of the reasons and fees. If the premises appear dirty or damaged upon Check-in, Guest shall inform the homeowner immediately by calling 209-962-4477 and asking for Cecile.

b. Rental Rate. Payment in full of the following fees shall be due no later than 30 days prior to the Check-in Date:

9. Cancellation Policy: There are no refunds for cancellation regardless of notice or reason. We strongly advise that you purchase vacation cancellation insurance. It is available at very reasonable rates and will allow you to receive money back in the event of an emergency that necessitates last minute cancellation.

10. Insurance: We encourage all renters to purchase traveler insurance and damage insurance.

11. Payment: Acceptable payment methods are credit card only. We accept credit cards through PayPal or through various property advertisement websites (AirBnB, VRBO).

The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below.
